Nubia Terms of Use
Effective date: 2026-09-13
Terms version: 1.0
These Terms explain the agreement for using the Nubia app, heynubia.com, and related services that refer to these Terms. “Nubia,” “we,” and “us” mean Emine Kuzhan, an individual based in Türkiye.
App Store publisher/seller: Emine Kuzhan.
Contact support@heynubia.com for service, billing, accessibility, content, or legal questions. For personal-information requests, contact privacy@heynubia.com.
Nubia’s website does not sell subscriptions directly. For an Apple-billed purchase, the seller and transaction information are identified in the App Store purchase flow and your receipt. These Terms do not replace any supplier, contact or pre-contract information that the responsible seller must provide for your transaction under applicable law.
1. Accepting these Terms and other applicable terms
These Terms apply to your use of the Nubia service to the extent a valid agreement is formed under applicable law. Where express acceptance or specific pre-purchase disclosures are required, they must be provided in the relevant account or purchase flow. Displaying these Terms alone is not a statement that you have given that acceptance. Merely viewing a privacy notice does not authorize optional analytics, sensitive-data processing, or other activities that require separate consent.
Our Privacy Policy explains information handling. Separate permission and consent choices govern optional features such as Apple Health, product-photo uploads, location, and certain sharing. The Cookie Notice describes website analytics and browser storage.
Store purchase terms also apply when you obtain the app or a subscription from Apple. Any additional feature terms must be clearly presented before you agree to that feature. Nothing in these Terms overrides mandatory rights under the law applicable to you. If a mandatory local rule requires a translation, disclosure, cancellation method, remedy, or particular contract term, that rule takes priority.
2. Eligibility and your account
The 13+ AI eligibility rule in section 5 applies only to optional AI-assisted features. This AI-only restriction does not set a minimum age of 13 for the Nubia app, accounts, or non-AI features. Separate children's-data, health-data, consent and legal-capacity requirements still apply. Where local law requires legal capacity or a parent or guardian’s consent for an account, sensitive information, or a non-AI feature, that requirement applies separately. A child must not use a feature for which they are ineligible or for which required permission is missing.
Use your own account and provide accurate information needed for the features you choose. Do not impersonate someone else, provide another person's health information without lawful authority, or misrepresent your age or parental permission. The photo eligibility declaration, where that optional feature is available, does not independently verify age or parental identity. Required permission and applicable eligibility restrictions still apply.
You are responsible for keeping your device and sign-in credentials reasonably secure. Tell us promptly if you suspect unauthorized access. You are not automatically responsible for every unauthorized use merely because it occurred through your account; liability depends on the facts and applicable law.
Some features require an account, internet access, a supported device/OS, permission settings, or a paid plan. Your carrier or internet provider may charge for data, including roaming. Feature availability can differ by version, region, device, language, and subscription offering.
3. What Nubia provides
Nubia provides consumer skincare education and organization tools. Depending on availability, these include product and ingredient information, a personal product Shelf, routine suggestions and adaptations, skin-related check-ins, reactions and progress records, wellness reminders, environmental information, private journaling, shared activities, and optional product-photo catalog matching.
Suggestions depend on the information you enter, the product information available to Nubia, and the rules or services used by the feature. They can be incomplete, outdated, or unsuitable for your individual circumstances. A recommendation, product score, ingredient explanation, “safety” label, reminder, or absence of a warning is not a guarantee that a product is safe or effective for you.
We may correct catalog data and improve the service. We remain responsible for the quality and accuracy obligations that applicable law imposes on us; the limitations described here do not excuse misleading claims or remove mandatory consumer remedies.
4. Skincare and health limitations
Nubia is not a healthcare provider, emergency service, diagnosis service, or substitute for a qualified clinician. It does not establish a clinician–patient relationship, prescribe medicines, monitor you for emergencies, or promise to prevent, treat, or cure a condition. Names such as “care,” “reaction,” “barrier,” or “rescue” describe app features and are not clinical certifications.
Use the instructions and warnings on the actual product you own, and follow your clinician's advice. Product formulas, packaging, ingredient lists, concentrations, availability, and regulatory status can differ by market or change over time. Check that any catalog match is the exact product and version you have. A database entry does not replace the physical label or professional advice.
Do not start, stop, or change a prescribed treatment because of an app suggestion. Discuss concerns involving a diagnosis, medication, pregnancy, breastfeeding, trying to conceive, an allergy, a recent procedure, or persistent/severe symptoms with an appropriately qualified professional. A routine being generated from your answers does not establish that all interactions or contraindications were checked.
If a product causes irritation or another concerning reaction, stop relying on the app to assess it and seek appropriate professional advice. For a possible emergency, such as breathing difficulty or a severe allergic reaction, contact local emergency services immediately. Do not wait for a notification, a check-in, or a support reply. Our support channels are not monitored as emergency clinical channels.
Wellness tools are informational. UV/weather information can be delayed, incomplete, or inaccurate; an SPF reminder does not measure your actual sun exposure or guarantee protection. Hydration reminders do not set an individualized medical fluid requirement. Sleep, workout, and menstrual-history displays are not diagnostic tools. Menstrual timing estimates are not fertility, ovulation, contraception, or pregnancy advice.
5. Optional product-photo recognition and automated suggestions
Optional AI-assisted features, currently Shelf product-photo recognition, are for users aged 13 and over. If you are 13–17, you need a parent or guardian’s permission to use these AI features. Higher local age or digital-consent requirements for AI use still apply. Do not use these AI features if you are under 13, below a higher applicable AI minimum age, or without required permission. Parent/guardian permission does not override these requirements.
Shelf photo recognition sends the photo of your products that you take in the app or choose from your photos through Nubia's service to OpenAI to suggest possible catalog matches. You must meet these AI eligibility and guardian requirements and separately agree to that selected upload to OpenAI. Earlier consent to another provider does not authorize the upload. A parent or guardian's permission does not override applicable law or provider restrictions. Manual product search is available without that upload.
Recognition can misread a name, packaging, size, or product variant. Review each suggested match before saving or relying on it. Do not upload faces, private documents, prescription labels containing personal details, or material you have no right to share. This feature identifies products; it does not assess your skin or provide a diagnosis.
Ordinary routine personalization in the implementation covered by these Terms uses Nubia's rules and your inputs. The use of automation does not turn a suggestion into clinical advice or make a recommended product appropriate in every circumstance. You remain free to change your choices, decline a recommendation, or seek professional guidance.
Optional features can have usage limits, regional restrictions, or temporary availability limits, presented in the app. Do not evade an age, safety, access, or usage restriction. Our Privacy Policy explains the image, provider-retention, and abuse-prevention data handling.
6. Your content, journal, and sharing
You retain your rights in content you provide, such as personal notes and photos. You give us only the non-exclusive permission needed to receive, store, process, format, and display that content to provide the feature you request, and to send it to the service providers or recipients necessary for that feature. This permission lasts only as needed to provide the feature, fulfill a lawful retention duty, or complete deletion as explained in the Privacy Policy.
This is not a general right to publish your private journal, sell your health information, use your content in advertising, or train unrelated general-purpose AI models. Any such materially different use would need a separate lawful basis and any required specific consent. Providers' relevant processing, including OpenAI's abuse monitoring, is described in the Privacy Policy.
Only submit content you have the necessary rights and permissions to use. Keep it relevant to the feature. Do not submit unlawful content, malicious files, or another person's private information without authority. You may offer feedback voluntarily; we may use non-confidential suggestions to improve Nubia without an obligation to pay for them. This does not give us permission to reuse personal health information for unrelated purposes.
The current journal is stored locally. It is not a guaranteed cloud backup. If you want to preserve local content, use available sharing/export options and keep a copy you control before changing devices or uninstalling the app. Other app information, such as wellness or concern notes, may be stored with your account instead. Consult the Privacy Policy for the distinction.
Friends, care-circle and shared-night features are optional social tools. A friend-code preview may identify you to someone who has the code. Connected people may see enabled routine activity or information about a shared invitation, theme and schedule. Review sharing preferences and the invitation before sending it. You can use available controls to pause sharing, remove a connection, block a person, or change your code. These actions cannot recall an independent screenshot or copy already made by a recipient.
Do not harass, threaten, impersonate, discriminate against, or send repeated unwanted invitations to another person. You may report misuse or unlawful content to support@heynubia.com, including enough information to locate the issue without unnecessarily sharing sensitive data. We may investigate, restrict contact features, remove unlawful material, or suspend an account where justified. If we take an adverse action, we explain it and provide a way to contact us for review unless doing so would be unlawful or compromise safety/security. No in-app reporting function is promised where it is not available.
7. Acceptable use
Use Nubia for lawful personal purposes within the access granted to you. You must not:
- Attempt to access someone else's account or data, bypass authorization, compromise the service, or interfere with other users.
- Upload malicious code, exploit the service, or deliberately evade reasonable rate limits and safety controls.
- Extract substantial parts of our proprietary content or databases, resell access, or reproduce protected materials without permission or a legal right.
- Use the service for unlawful discrimination, surveillance, deceptive endorsements, or decisions about someone else's employment, insurance, or access to healthcare.
- Misrepresent yourself as a clinician acting for Nubia or present Nubia's content as a professional diagnosis.
These restrictions do not limit rights that cannot lawfully be restricted, including permitted interoperability, accessibility, fair use/fair dealing, data access, or lawful security research. Contact us to report a vulnerability without accessing unnecessary data or disrupting the service. Nothing in these Terms prohibits an honest review, a lawful complaint, or communication with a regulator.
8. Subscriptions, trials, and payment
Purchase information
Paid access is available only through the purchase options actually shown to you. Before you confirm, the purchase screen and store checkout identify the included access, price, currency, billing period, any tax information required by law, renewal conditions, and any trial or introductory offer. Actual store-provided terms control the offer you accept; example prices or plan names elsewhere do not create an offer.
An auto-renewing subscription continues for successive billing periods unless cancelled through the applicable store controls. Charges are made to your store account according to the store's terms. A trial, if offered and accepted, can convert to a paid subscription at the disclosed price and interval unless you cancel in time. Trial eligibility, duration, and cancellation consequences must be shown with the actual offer; no universal free trial is promised.
For Apple subscriptions, renewal processing can occur within the 24 hours before the current period ends. Apple advises cancelling a free or discounted trial at least 24 hours before it ends if you do not want renewal. Check the specific offer and cancellation information displayed in your Apple account. No promotional price is guaranteed beyond the period expressly offered.
RevenueCat helps Nubia validate transactions and manage access. Apple, or the seller identified in your store receipt, handles the store transaction. Nubia's website does not currently sell subscriptions directly or collect card payments. If direct web billing is introduced, its seller, payment, cancellation, tax, and withdrawal terms must be provided before purchase.
Cancellation and restoration
For an Apple purchase, open iPhone Settings → your name → Subscriptions → Nubia, then use the cancellation option. You can also follow Apple's cancellation instructions. If you cannot locate a subscription, check which Apple account or provider billed you and contact us or Apple for help.
Cancelling renewal usually allows access until the end of the paid period shown by the store. Trial cancellation or refunds may end access earlier under the applicable offer or store rules. Use Restore Purchases in the app with the relevant store account to restore eligible access. Some issues may require support or store verification.
Deleting the app, signing out, or deleting your Nubia account does not cancel store renewal. If you want both account deletion and billing cancellation, complete both actions. We must not make a statutory deletion request conditional on keeping an account or cancelling first. If access ends because your account is deleted, any further financial rights remain subject to applicable law and the store transaction.
Changes to price or paid features
Price changes take effect only through the required notice and consent process, including store requirements and mandatory local law. We do not retroactively change the price of an already paid period. You can decline a change by cancelling renewal before it takes effect, subject to any additional rights applicable to you.
If we materially reduce or discontinue paid features during a period for which you paid, we will provide the notice and remedy required by applicable law, which may include continued access, cancellation, or a proportionate refund. A general right to update software does not allow us to remove what we sold without the required remedy.
For EEA consumers where the digital-service modification rules apply, a change beyond what is necessary to maintain conformity must have a valid reason under the contract, be made without extra cost, and be clearly explained. If it adversely affects your access or use by more than a minor amount, you may have a right to terminate free of charge within 30 days of receiving notice or implementation, whichever is later. This right is subject to the applicable exception where the unchanged, conforming service remains available to you without extra cost. Required advance notice is provided on a durable medium, such as email.
9. Refunds and statutory withdrawal rights
For an Apple-billed purchase, request a refund through Apple's refund process or Report a Problem. Eligibility and processing depend on the transaction, store rules and applicable law. You may also contact support@heynubia.com for help identifying the transaction or asserting a right against Nubia. We do not require you to abandon a statutory claim because a store refund tool declined it.
There is no blanket “all sales are final” rule in these Terms. You keep all non-excludable rights relating to faulty, misdescribed, unavailable, or unlawfully supplied digital content/services, unauthorized charges, and applicable cancellation or withdrawal rights. We do not promise an unconditional money-back guarantee beyond an offer expressly made to you or a right required by law.
EEA and UK consumers. Distance contracts generally carry a 14-day withdrawal period, subject to the rules for the particular supply. Starting a continuing digital service is not automatically a waiver of all withdrawal rights. For digital content not supplied on a tangible medium, loss of withdrawal rights requires the applicable legal conditions, including prior express consent and acknowledgement where required. For services started at your express request during the withdrawal period, a proportionate charge may be permitted only where the legal requirements are satisfied. Applicable rights for non-conforming digital content/services also continue. We do not infer these separate consents from general acceptance of these Terms.
To exercise an applicable withdrawal right, use the store's mechanism where relevant, or send a clear statement to support@heynubia.com. Identify the subscription, order date and the account or receipt needed to find it. A particular form or legal phrase is not required. Keep a record of sending your request. If the law requires reimbursement, we or the responsible transaction seller will provide it within the applicable deadline and by the legally required method.
Purchases are concluded through Apple, not through a Nubia website checkout. Use the purchase and refund controls associated with your Apple transaction, or contact support@heynubia.com for help exercising an applicable withdrawal right against Nubia. If a covered online contract requires a dedicated withdrawal function, the responsible trader must make that function available through the applicable interface, with the confirmation and durable acknowledgement required by law. An ordinary renewal-cancellation button does not necessarily exercise a statutory withdrawal right, and this notice does not present Apple’s refund tool as a substitute for every legally required function.
Sending a withdrawal statement
You can email Emine Kuzhan at support@heynubia.com with a clear statement that you wish to withdraw from your Nubia service or subscription contract. Include your name, order date, subscription or service and order reference, and a reply address so the relevant transaction can be located. Include a signature only if sending a paper statement where one is required. Do not send payment-card details.
This is a convenient way to communicate a request, not a prescribed statutory form. You may use any statutory form supplied by the responsible transaction seller or another unequivocal statement where the law permits. Providing these instructions does not remove a trader’s duty to supply a prescribed form or the information legally required for your purchase.
Australia and New Zealand. These Terms do not exclude applicable consumer guarantees or remedies for services that fail to meet them. In Australia, remedies under the Australian Consumer Law can include cancellation/refund or compensation depending on the failure. New Zealand statutory protections likewise remain available where applicable.
Other markets. Any mandatory cooling-off period, renewal reminder, easy-cancellation rule, refund, price disclosure, warranty, or other consumer protection in your jurisdiction takes priority. Local purchase disclosures must explain additional requirements where they apply.
10. Content ownership and third-party material
Nubia's software, original design, editorial material, and branding are owned by the operator or used under license. Your personal use of Nubia's service and editorial content is subject to these Terms. The iOS app's software license is governed separately by the Apple Standard EULA identified in section 14, not by a license grant in these Terms. We do not transfer ownership of the service to you.
Product names, logos, packaging, third-party photographs, source quotations, and linked materials belong to their respective owners. Including a brand or product in Nubia does not imply endorsement, affiliation, sponsorship, or a guarantee. Product manufacturers and sellers remain responsible for their own products and statements. Nubia remains responsible for claims it makes itself.
You may use or quote content to the extent permitted by law. Do not remove required attribution from permitted copies or imply an endorsement that does not exist. Open-source and other third-party license rights continue to apply to their respective materials.
If you believe material infringes your rights, contact support@heynubia.com with your contact details, the specific material/location, the rights involved and the basis of your concern. We will assess appropriate action and any legally required notice process. This contact is not a representation that a particular statutory copyright-agent registration has been completed.
External links, exported files, third-party apps, and stores operate under their own terms and policies. We do not control their independent content or practices. Any sponsorship, affiliate commission, or paid endorsement must be clearly disclosed where it could affect your decision; these Terms are not a substitute for that disclosure.
11. Service updates, interruptions, and ending access
We may update Nubia to fix issues, protect security, improve features, comply with law, or respond to a provider change. Install supported security updates where needed. We provide mandatory updates and notices for the period required by law; compatibility changes do not remove rights relating to what you purchased.
Access may be interrupted by maintenance, connectivity problems, device conditions, or provider outages. Reminders and social updates are not guaranteed to arrive at a particular time and must not be used for emergency or critical care. This limitation does not excuse a breach of a mandatory service-quality obligation.
We may restrict or suspend access where reasonably necessary to address a material breach of these Terms, unlawful activity, a serious security/safety risk, or a legal requirement. We act proportionately and provide notice and an opportunity to remedy the issue or request review where appropriate. Urgent safety/security action may be taken first. We do not suspend an account merely because you made an honest criticism or exercised a legal right.
You can stop using Nubia at any time, cancel your subscription as described above, and request account deletion. If we discontinue the service, we provide reasonable notice where practicable, an opportunity to obtain available data where required, and any remedy due for unused paid access. Retention and deletion are governed by applicable law and the Privacy Policy, not an unlimited license to keep your content.
12. Responsibility and limits
We must provide the service with the care and quality required by applicable law and honor the commitments we make. Because skincare responses and available data vary, we do not guarantee a particular cosmetic or health result, perfect catalog coverage, error-free automated output, or uninterrupted availability.
To the extent allowed by applicable law, we are not responsible for loss that was not reasonably foreseeable from a breach of these Terms, or business losses arising from use of a consumer service for business purposes. Responsibility for other losses depends on the applicable law and the circumstances, including a party's contribution to the loss and reasonable steps to reduce it.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud, intentional misconduct, gross negligence where protected, death or personal injury caused by negligence where protected, violations of applicable data-protection rights, or mandatory consumer guarantees. We do not require you to indemnify us for our own wrongdoing. No contractual liability cap overrides a non-waivable remedy.
13. Complaints, law, and disputes
Please contact support@heynubia.com if you have a complaint so we can try to resolve it. You are not required to complete a private complaint procedure before exercising a right that the law lets you exercise immediately.
These Terms do not select a particular governing law. The law determined by applicable choice-of-law rules applies, including the mandatory consumer protections of your habitual residence where applicable.
You may bring proceedings in any court available to you under applicable consumer/jurisdiction rules, including your local courts where the law permits. These Terms do not impose mandatory arbitration, an exclusive foreign court, a class-action waiver, or a shorter statutory limitation period.
These Terms do not designate a private alternative dispute-resolution scheme or require you to use one. If applicable law requires us to participate in a particular procedure or provide dispute-body details for your complaint, those requirements still apply and the relevant information must be supplied. You may also complain to an appropriate consumer or privacy authority. A contact or dispute clause does not restrict that right.
14. Apple app license
The Nubia iOS app is licensed under Apple's Standard Licensed Application End User License Agreement. These Terms govern the Nubia service; they do not grant a separate iOS software license or replace or modify the Standard EULA. The Standard EULA can also cover services accessed or purchased through the app; it controls the software license and any conflict concerning that license. Nubia will honor the additional service commitments and remedies expressly provided in these Terms; its reliance on the Standard EULA does not reduce those commitments or mandatory rights under law.
Nubia, rather than Apple, is responsible for the Nubia service and its content, support and relevant service claims, subject to Apple's own obligations as distributor or transaction seller. Use of the app must comply with applicable App Store usage rules.
15. Changes to these Terms
We may change these Terms for a valid reason, such as a change to the service, law, safety needs, or provider requirements. We identify the new version and effective date and give reasonable advance notice of material changes where required. Changes apply prospectively. Any change requiring renewed agreement or separate consent will use the required process.
If you do not accept a material change, you can stop using the affected service and cancel renewal. Any right to end a prepaid contract or receive a refund remains governed by applicable law. We cannot treat continued use as a waiver of a mandatory right.
If a provision is invalid or unenforceable, it is ineffective to the extent required by law; the remainder continues only if it can lawfully do so. A delay in enforcing a right is not automatically a waiver. If the service/operator is transferred, your rights and our obligations must be preserved and any required notice or consent supplied. Nothing in these Terms makes you a partner, employee, agent, or representative of Nubia.
Mandatory language rules apply. An English version does not automatically override a legally required local-language version or a consumer's right to rely on it. Contact us if you need an accessible format or help understanding these Terms.
